Terms and Conditions

Please read our terms and conditions carefully

1. ICECREAM PARTY HIRE agrees to rent to the Renter, and the Renter agrees to rent from ICECREAM PARTY HIRE, the equipment listed in the chosen package.

2. The rental period will last from the time of delivery until the arranged pick up time, which will be discussed and agreed between ICECREAM PARTY HIRE and the Renter. If the Renter does not present the equipment to ICECREAM PARTY HIRE at the time and date that has been agreed to be picked up, the Renter will incur an additional rental charge of $500 per day for each day or partial day beyond the end of the rental period until the equipment is returned.

3. The Renter will return the equipment to ICECREAM PARTY HIRE in the same good condition as received. The renter is responsible for the equipment whilst in their possession. If the equipment is damaged before the Renter returns it, the Renter will be responsible for the replacement cost of the equipment. If the equipment is lost or stolen before Renter can return it, Renter will pay ICECREAM PARTY HIRE its complete replacement cost.

4. Some candy toppings and sweets contain traces of nuts. It is your responsibility to check if any guests have allergies and make sure they do not consume these candies. It is your responsibility to contact ICECREAM PARTY HIRE if you require further information about the ingredients in a particular candy.

5. ICECREAM PARTY HIRE reserves the right at any time to change the list of flavours, toppings and candies available, specials or prices on the website.

6. ICECREAM PARTY HIRE reserves the right to replace your designated machine within 24 hours notice if the original machine is deemed to be faulty and not working. The customer accepts that if a back up machine is required due to fault of the original machine, a different model of machine not shown on the website may be used.

7. ICECREAM PARTY HIRE reserves the right to not set up a machine if the environment is deemed to be unsafe for the machine or for the driver to set it up if the location is not safely accessible due to stairs, elevation and steep descents.

8. If a client helps a driver to set up the machine, this is their decision and ICECREAM PARTY HIRE do not accept responsibility if the customer injures themselves in any way.

9. If a machine does not freeze due to the environment it has to be placed in (e.g. cramped area, no ventilation, non air conditioned area) or if the power supply is not suitable to keep the machine running, the client will still be required to pay the full amount.

10. The client must advise ICECREAM PARTY HIRE if there is steep terrain or stairs so we can make arrangements for delivery. We reserve the right not to deliver an Ice Cream machine if this information is withheld from us.

11. Hirer must provide a standard power point and any extension cords needed to have power within 1m of the machine. Power boards cannot be used as the machines draw too much power for them and can cause them to cut out. For hires of more than one machine, you will need to run separate power cords for each machine.

12. ICECREAM PARTY HIRE is not responsible if the mix leaks and stains bench tops, flooring or carpet. The hirer is responsible and must provide a drop sheet should they want to protect the area where the machine will be situated.

13. If the renter is not happy with the machine design/layout or products supplied by ICECREAM PARTY HIRE on delivery, then the renter has the right to request a full refund. Only while in the presence of an ICECREAM PARTY HIRE employee on delivery. (excluding the $100 deposit)

14. Some Public Holidays and Public Holiday Eve’s attract a price surcharge. Please contact us for pricing.

15. ICECREAM PARTY HIRE deliveries are free within 25kms of each cities base. Deliveries outside this zone may still be arranged but will incur a extra delivery charge, please email or contact us for pricing.

16. ICECREAM PARTY HIRE machines can be pick up on the same night for times between 9:00pm – 1:00am, if you have to be out of a hall, boat or function centre that night. An additional fee of $100 applies to a night pick up.

17. All bookings are subject to the availability of the Ice Cream machines and Toppings.

18. The laws of VIC shall govern this agreement. Venue for any legal proceedings brought in connection with this contract shall be in VIC.

19. The Renter agrees to defend, indemnify, assume liability for and hold ICECREAM PARTY HIRE harmless from any and all claims, demands, damages, losses, suits, proceedings, penalties, expenses or other liabilities including attorney fees and court costs, arising out of or resulting from the use of the Equipment, regardless of the basis.

20. Renter may not transfer this contract to another party without the prior written consent of ICECREAM PARTY HIRE.

21. Any changes must be written and signed by both the Renter and ICECREAM PARTY HIRE. Oral agreements are non-binding. The latest contract supersedes all previous contracts between Renter and ICECREAM PARTY HIRE for the specific rental listed above. This agreement binds and benefits the heirs, successors and assignees of the parties

22. If any court determines that any provision of this agreement is invalid or unenforceable, any invalidity or unenforceability will affect only that provision and will not make any other provision of this agreement invalid or unenforceable and shall be modified, amended or limited only to the extent necessary to render it valid and enforceable.

23. If one party waives any term or provision of this agreement at any time, that waiver will only be effective for the specific instance and specific purpose for which the waiver was given. If either party fails to exercise or delays exercising any of its rights or remedies under this agreement, that party retains the right to enforce that term or provision at a later time.
